Welcome to our booking platform! Please read these terms and conditions carefully before using
Our service.
Definitions
Affiliate means an entity that controls, is controlled by or is under common control with a party,
where "control" means ownership of 50% or more of the shares, equity interest or other
securities entitled to vote for the election of directors or other managing authority.
Astoundinn is referred to as either "the Company", "We", "Us" or "Our" in this Agreement.
Device means any device that can access the Service such as a computer, a cellphone or a
digital tablet.
Service refers to the Website and any associated mobile applications or booking channels
operated by Astoundinn.
Terms and Conditions (also referred as "Terms"mean these Terms and Conditions that form
the entire agreement between the parties regarding the use of the Service.
Third-party Social Media Service means any services or content (including data, information,
products or services) provided by a third-party that may be displayed, included or made available
by the Service.
You means the individual accessing or using the Service, or the company, or other legal entity
on behalf of which such individual is accessing or using the Service, as applicable.
Acceptance of Terms
By accessing, browsing or using the Service, or by creating an account or completing a booking,
You confirm that You have read, understood and agree to be bound by these Terms, as well as
by Our Privacy & Cookie Use Policy and Our Cancellation & Refund Policy, which are
incorporated herein by reference. If You do not agree with any part of these Terms, You must not
use the Service.
The Service is intended for use by individuals who are at least 18 years old or who have reached
the age of majority in their jurisdiction of residence. By using the Service, You represent that You
meet this requirement or that You are using the Service under the supervision of a parent or legal
guardian who agrees to be bound by these Terms.
Intellectual Property
The Service and its original content (excluding content provided by You or other users), features
and functionality, including but not limited to text, graphics, logos, icons and software, are and
will remain the exclusive property of Astoundinn and its licensors. The Service is protected by
copyright, trademark and other laws of Portugal and other countries. Our trademarks may not be
used in connection with any product or service without Our prior written consent.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use
the Service strictly for its intended purpose of making bookings and reservations. Any other use,
including reproduction, modification, distribution or public display of any part of the Service
without Our prior written permission, is strictly prohibited.
Third-Party Social Media Services
The Service may display, include or make available content from, or provide links to, Third-party
Social Media Services. Astoundinn has no control over and assumes no responsibility for the
content, privacy policies or practices of any Third-party Social Media Service. Your interactions
with any Third-party Social Media Service accessed through the Service are governed solely by
the terms and policies of that third party, and We encourage You to review them before use.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Astoundinn, its Affiliates,
directors, employees or partners be liable for any indirect, incidental, special, consequential or
punitive damages, including loss of profits, data, use, goodwill or other intangible losses,
resulting from Your access to, use of, or inability to use the Service.
Save for damages that cannot be excluded or limited under mandatory Portuguese consumer
protection law, Astoundinn's total liability arising out of or relating to these Terms or the Service
shall not exceed the amount actually paid by You for the specific booking giving rise to the claim.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind,
whether express or implied, except as required by applicable law.
Termination
We may suspend or terminate Your access to the Service, without prior notice, if You breach
these Terms, engage in fraudulent or unlawful conduct, or if We are required to do so by law or
by a competent authority.
You may stop using the Service and, where applicable, request the closure of Your account at
any time by contacting Us. Termination does not affect any rights or obligations, including
payment obligations, that accrued prior to the termination date, nor any confirmed bookings
governed by Our Cancellation & Refund Policy.
Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, We
will make reasonable efforts to notify You, for example by posting a notice on the Service or
updating the effective date and version number, prior to the revised Terms taking effect. Your
continued use of the Service after any revision becomes effective constitutes Your acceptance of
the revised Terms.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Portugal,
without prejudice to any mandatory consumer protection provisions applicable in Your country of
residence. Any dispute arising out of or in connection with these Terms or the Service shall be
submitted to the competent courts of Portugal, save where a different jurisdiction is mandatorily
applicable under Portuguese law.
In accordance with Law No. 144/2015, if a dispute cannot be resolved directly with Astoundinn,
You may resort to an alternative dispute resolution (ADR) entity, and You may also lodge a
complaint with the Comissão Nacional de Proteção de Dados (CNPD) regarding any data
protection matter.
Severability
If any provision of these Terms is held to be unenforceable or invalid under applicable law, such
provision shall be changed and interpreted to accomplish the objectives of such provision to the
greatest extent possible under applicable law, and the remaining provisions will continue in full
force and effect.
